Murder Charges Dropped for Hayward Woman

A Hayward woman, who was charged with killing her brother during an alleged home robbery, had her charges dropped by prosecutors, with the help of her criminal defense lawyer, Ernie Castillo. The actual murder was committed by a 23-year-old Hayward resident after the victim's sister and unknown woman allegedly invaded the home.

The 27-year old woman was charged under a provocative act doctrine, which holds any accomplices responsible if a killing occurs during a criminal act, such as robbery. The defendant's Oakland criminal defense attorney, explains that there was an insufficient amount of evidence that points to the woman committing or planning to commit a crime on the night of her brother's murder.

Attorney Castillo explains that there was no home invasion robbery, claiming the incident was a drug deal that ended badly, with the sister being shot in the chest during the confrontation. The woman pleaded no contest of felony burglary in a plea deal. Both robbery and murder charges were dropped.

After spending almost a year in jail since the arrest, the woman was sentenced to five year felony probation and obtained credit for her time spent in jail.
